Acceptance and Scope

Welcome to Aurex Limited. These Terms of Use govern your access to and use of the Aurex website, client account area, investment-related services, educational materials, digital interfaces and other services made available through the platform.

By accessing the platform, creating an account or using any Aurex service, you acknowledge that you have read, understood and agree to be bound by these Terms of Use and any other applicable policies, disclosures or agreements referenced by Aurex.

If you do not agree with these terms, you should discontinue use of the platform and should not open or maintain an account with Aurex.

Eligibility to Use Aurex

You must be at least 18 years old, or the minimum legal age applicable in your jurisdiction, to create and operate an Aurex account.

By registering, you confirm that you have the legal capacity to enter into these Terms of Use and that your use of the platform is lawful in the jurisdiction where you are located.

Aurex may restrict access to particular services or decline account applications where providing those services would not be appropriate or permitted under applicable laws, regulations, internal policies or risk controls.

Account Opening and Account Security

To access certain Aurex services, you may be required to create a personal account and provide accurate information during the registration and verification process.

Accurate Information

You agree to provide information that is complete, accurate and current. This may include your name, contact details, identification information and other information required to establish and maintain your account.

You are responsible for updating information when circumstances change or when Aurex requests updated documentation.

Account Credentials

Your login credentials and authentication information must be kept confidential. You should not share your password, authentication codes or other security credentials with another person.

You are responsible for activity carried out through your account unless you have promptly notified Aurex of unauthorized access or another security concern.

Aurex Platform and Services

Aurex provides an online platform through which eligible users may access information and investment-related opportunities across selected asset and market categories.

Depending on availability, account status and applicable conditions, the platform may provide access to areas including:

Services, products, investment opportunities and availability may change over time. Not every service is necessarily available to every client or in every jurisdiction.

Trading and Investment Conditions

Where Aurex provides access to trading or market-linked activities, transactions are subject to the applicable product conditions, market conditions, liquidity and execution arrangements.

Market prices can change rapidly. The price displayed when you review an opportunity may not necessarily be the price available when a transaction is submitted or executed.

Orders and Transactions

Orders and investment instructions may be subject to available liquidity, market conditions, processing requirements, minimum amounts and other applicable conditions.

Once an instruction has been processed or executed, it may not always be possible to cancel, amend or reverse it.

Leverage

Where leveraged products or trading facilities are made available, leverage can significantly increase both potential gains and potential losses.

Clients should understand the operation and risks of leverage before using any leveraged facility.

Deposits, Withdrawals and Refunds

Funding and withdrawal requests must be completed using the payment methods and procedures made available through the Aurex platform.

Deposits

Funds are credited to an account after they have been received and, where applicable, cleared and processed through the relevant payment provider.

Payment methods used to fund an account should belong to the account holder. Aurex may reject or return third-party payments where permitted by applicable requirements and internal controls.

Withdrawals

Withdrawal requests may be subject to identity verification, account checks, transaction reviews and other security procedures.

Where applicable, withdrawals may generally be returned through the original payment method or account used to fund the account, subject to applicable limits and verification requirements.

Refunds

Investment losses resulting from market movements are not automatically refundable. Where a refund or reversal is appropriate, it may be subject to verification and applicable payment-provider procedures.

Investment Risk

Investment and trading activities involve financial risk. Depending on the service or underlying asset, you may lose part or all of the capital you commit.

Cryptocurrency, stocks, indices, commodities, agricultural investments, real estate-related investments and other investment activities can be affected by market conditions, economic developments, liquidity, interest rates, political events, technology, underlying project performance and other factors.

Past performance, historical prices or previous investment outcomes should not be interpreted as a guarantee of future results.

No Guaranteed Investment Outcome

Unless expressly stated in a legally applicable product agreement, Aurex does not represent that an investment will produce a particular return or that your capital will be preserved.

You should only commit funds that you understand may be exposed to investment risk.

Prohibited Activities

You agree not to use Aurex or any associated service for unlawful, fraudulent, abusive or unauthorized purposes.

Prohibited conduct includes, but is not limited to:

• Providing false, inaccurate or misleading information.
• Opening or operating an account on behalf of another person without authorization.
• Attempting to gain unauthorized access to another user's account or platform systems.
• Attempting to manipulate markets, transactions, prices or platform functionality.
• Using Aurex for money laundering, terrorist financing, fraud or other unlawful activities.
• Circumventing security, verification or transaction controls.
• Introducing malicious software, automated attacks or other activity that could compromise platform security.
• Using the platform in violation of applicable laws or restrictions in your jurisdiction.

Aurex may investigate suspected violations and may take appropriate action, including restricting account access, cancelling transactions where appropriate or terminating an account.

Intellectual Property

Unless otherwise stated, the Aurex website, platform interfaces, designs, branding, logos, text, graphics, software, educational materials and other original content are owned by or licensed to Aurex and are protected by applicable intellectual property laws.

You may access and use platform content for your personal and lawful use in connection with the services provided to you.

You may not reproduce, distribute, modify, publish, sell, reverse engineer or commercially exploit Aurex content without appropriate authorization.

Platform Availability and Third-Party Services

Aurex aims to maintain reliable access to its platform but does not guarantee that the website or every service will always be available, uninterrupted or free from technical errors.

Temporary interruptions may occur because of maintenance, software updates, network issues, cybersecurity incidents, infrastructure failures, market conditions or circumstances outside Aurex's reasonable control.

Certain functions may also depend on third-party technology, payment providers, financial infrastructure, liquidity sources, hosting providers or other external service providers.

Third-party services may be subject to their own terms, conditions and availability requirements.

Limitation of Liability

To the extent permitted by applicable law, Aurex will not be responsible for losses arising solely from circumstances beyond its reasonable control, including market movements, market volatility, interruptions to third-party services, network failures or events affecting financial markets.

Aurex does not guarantee that the platform will always operate without interruption, delay, technical defects or errors.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation would not be permitted under applicable law.

Account Suspension and Termination

Aurex may restrict, suspend or terminate access to an account where there are reasonable grounds to do so, including suspected fraud, security concerns, failure to complete required verification, violation of these Terms or other applicable policies.

Restrictions may also be applied where required for legal, regulatory, sanctions, security or risk-management reasons.

Where appropriate and legally permitted, Aurex may provide information regarding the reason for a restriction or termination.

Closing Your Account

You may request closure of your account by contacting Aurex support, subject to completion of any outstanding transactions, verification requirements or other applicable obligations.

Closing an account does not automatically cancel obligations that arose before closure.

Changes to These Terms

Aurex may update these Terms of Use from time to time to reflect changes to the platform, services, legal requirements, operational procedures or other relevant circumstances.

When changes are made, the updated version will be published on the relevant page of the Aurex website together with a revised effective or update date.

Your continued use of the platform after updated terms become effective may constitute acceptance of the revised Terms, to the extent permitted by applicable law.
